Horizontal Property Law clearly defines the hierarchy in a community.
The Board of Owners (all owners) is the absolute power in a community. All monetary decisions, changes to services, investments, major structural works and election of committee members can only be made by the Board of Owners at an AGM/EGM.
The President of the committee is elected, from the owners, by way of a vote, or by rotation or draw (Horizontal Property Law Article 13.2).
The President acts as the voice/spokesperson for the community in relation to the Administrator and executes decisions taken at the AGM/EGM .
The President has no power to spend money that has not been approved at an AGM/EGM, other than for standard maintenance or emergency works, nor can he/she go beyond any previous approval of expenditure, without the necessary approval of a further AGM/EGM.
The President must legally represent the community, both in court and outside, in all matters affecting it.
The Vice Presidents (if necessary), similar to the President, are voted on and off of the committee by the Board of Owners. They are held and selected by the same standards as a President of the committee.
The Secretary can be part of the committee of owners, or the role can be held by the Administrator (which is the case in Bellaluz)
The Administrator is elected by the community and is responsible for the budget planning, budget control and execution of works according to the outcome of the AGM/EGM decisions.
